3. Use of Our Website

Permitted use: You may use our website to view and compare products, place orders, create and manage a customer account, contact our customer service, and sign up for newsletters.

Prohibited use: You may not use our website for unlawful or fraudulent purposes, attempt unauthorized system access, use automated scraping tools without permission, distribute malware, or use our trademarks and copyrighted material without consent.

Account security: You are responsible for keeping your login credentials confidential and for all activity on your account. Please report any unauthorized use immediately.

4. Products and Prices

We strive to provide accurate product information, including operating weight, dig depth, reach, engine power, track width, pin diameter and the width between mounting ears. Minor variations – for example due to screen settings, or small differences in shade, casting or packaging between production batches – are possible and are not a defect. All prices are in USD; applicable sales taxes are calculated at checkout. There are no hidden fees, no freight surcharge and no liftgate charge. Free standard shipping applies within the United States. Price changes do not apply to confirmed orders.

If a product becomes unavailable, we will offer you the choice of waiting, an alternative product, or a full refund.

5. Orders, Contract Formation, Changes, and Cancellations

Contract formation: The products shown on this website are an invitation for you to make an offer, not an offer by us. Your order is an offer to buy; a contract is formed only when we accept your order by sending a shipment confirmation. The automatic order-acknowledgement e-mail only confirms that we received your order and is not an acceptance.

We reserve the right not to accept orders in cases of obvious pricing errors, suspected fraud, unavailability, or payment problems.

Before shipment: Changes and cancellations are accepted where possible — please contact us as early as you can, as machines are booked onto a freight truck within 1–2 business days.
After shipment: Cancellation is no longer possible; the order can be returned in accordance with our Refund Policy.

6. Payment and Title

Accepted payment methods: Visa, Mastercard, American Express, Apple Pay, Google Pay. Payments are processed securely by Stripe, a certified PCI DSS Level 1 payment provider. We do not store complete card details on our own servers. We do not offer financing, leasing, rental or payment by invoice. Full detail is in our Payment Policy.

Title: Title to the goods passes to you on receipt of payment in full. Risk passes on delivery.

7. Shipping and Delivery

Full details in our Shipping Policy. In short:

Shipping area: Attachments and parts: all 50 states. Mini excavators: the 48 contiguous states only.
Processing time: 1–2 business days
Transit time: 3–6 business days
Total delivery time: 4–8 business days
Shipping cost: Free standard shipping, on attachments and machines alike
Carriers: USPS for items up to 70 lb, UPS or FedEx Ground for items up to 150 lb, LTL freight for anything heavier and for every machine
Machines: Delivered curbside by a freight carrier on a flatbed or drop-deck trailer, with an appointment call. You must provide a signature, safe truck access, firm level ground and roughly 60 ft of clear space, and you or your driver unload the machine down the ramps. Machines are too heavy for a liftgate.

8. Returns, Refunds, and Exchanges

Full details in our Refund Policy, which forms part of these terms. In short:

Return window: 30 days from delivery
Condition: Unused – a machine that has been fueled or started is no longer unused
Return shipping costs: Paid by the customer, except for defective or incorrect items
Restocking fees: None
Refund time: 5 business days after receipt plus 3–5 business days bank processing
Refund method: Original payment method
Exchanges: Accepted, subject to availability

9. Warranty

Every machine and attachment we sell is covered by the manufacturer’s written warranty that is supplied with it. Ask us before you order and we will send you the exact terms – the period, what is covered and what is not – in writing. We do not publish a warranty period here because it is set by the manufacturer of each item and we will not state a term we cannot stand behind.

How a claim works: e-mail info@nestiques.com with your order number, a description and photos. We handle the claim with the manufacturer on your behalf and arrange a repair, replacement parts, or a replacement item. We do not operate a dealer network, so everything goes through us.

Any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited to the duration of the written warranty supplied with the product, except where that limitation is not permitted by your state’s law.

Normal wear is not a defect: bucket teeth worn back with use, a ground-down ripper point, a rubber track worn by working on hardcore, or scuffed paint are not covered, and damage from misuse, overloading, running an attachment outside its stated machine weight range, disassembly or unauthorized repair is not covered either.

Some states do not allow limitations on implied warranties, so some limitations may not apply to you. This policy gives you specific legal rights, and you may also have other rights which vary from state to state. These terms do not limit any non-waivable rights you have under applicable law.

10. Intellectual Property

All content (text, images, logos, designs) belongs to Nestiques, DELMARE ECO LLC, or our licensors and is protected by copyright. No commercial use without written consent. Private use for viewing or printing is permitted.

11. User Content

Reviews and feedback you submit must be free of third-party rights. You grant us the right to use them in the course of our business operations. We remove unlawful or misleading content.

12. Privacy

13. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Maximum liability per order: the order value. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

14. Your Responsibility and Safe Use of the Equipment

You are responsible for providing correct order and address details, for safe access for a freight delivery, for keeping your account secure, for reviewing product information before purchase, and for complying with applicable laws.

The products we sell are hydraulic earthmoving machines and attachments capable of causing serious injury or death. Read the manufacturer’s instructions before first use. Do not operate a machine without training. Check for buried services before you dig – call 811 or your state’s one-call service. Keep bystanders clear of the working radius, never work under a raised boom or attachment, lower attachments to the ground and remove the key before leaving the machine or carrying out any maintenance, and always fit the safety pin on a quick coupler before use. Confirm that an attachment is within the weight range and pin specification of your machine before pinning it on. You are also responsible for checking your own state and local rules on operating and towing equipment, and for confirming that your towing vehicle and trailer are rated for the machine weight. We are not responsible for injury or damage caused by use that ignores the instructions supplied with the product.

Links to third-party websites are provided for information only. We accept no responsibility for their content or privacy practices.

16. Payment Providers

Payments are additionally subject to the terms of the respective payment provider.

17. Force Majeure

We are not liable for delays caused by natural disasters, pandemics, strikes, transportation problems, or other unforeseeable circumstances beyond our control. If such an event delays your order, we will tell you and agree a new date with you, or refund you in full if you prefer not to wait.

We make every effort to resolve complaints within a reasonable time. There is no mandatory arbitration clause in these terms: if we cannot agree, either of us is free to go to court, and nothing here prevents you using your state’s small claims process.

19. Governing Law and Jurisdiction

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Consumers retain any non-waivable rights under the laws of their state of residence.

20. General Provisions

Entire agreement: These Terms of Service, together with our Privacy Policy, Shipping Policy, Refund Policy, Payment Policy and Cookie Policy, form the entire agreement between you and Nestiques.

Severability: If any individual provision is found invalid, the validity of the remaining provisions is not affected.

Waiver: Our failure to enforce a right immediately does not constitute a waiver of that right.

Assignment: You may not assign your rights without our written consent.

Records: Your order details and these terms are sent to you by e-mail, and the current version of these terms is always available on this page.

21. Changes to These Terms

We reserve the right to update these terms at any time. Changes are published on the website. For material changes, we additionally inform you by e-mail. The version that applies to your order is the one published when you placed it. Continued use after publication constitutes acceptance.
